emergency stage be extended until 9/6/2024.
Reason for Extension:
DMAS is requesting this emergency regulation be extended until September 6, 2024 for the following reason: This extension is required in order to continue enforcing the legislative mandate, as set out in the 2021 Appropriations Acts, Item 317.GG(2), to clarify (i) the burden of proof in client appeals; (ii) the scope of review for de novo hearings in client appeals, and (iii) the timeframes for submission of documents and decision deadlines for de novo client hearings. This package is essential to clarify the client appeal rules for Medicaid members.
This emergency extension request was approved by the Governor's office on 1/17/2024.
