On 3/17/2017 the board requested that this emergency stage be extended until 10/25/2017.

Reason for Extension:
The Office of the State Inspector General (OSIG) submitted for publication an emergency regulation for the Fraud and Whistle Blower Reward Fund (1VAC42-30, CHAPTER 30, FRAUD AND ABUSE WHISTLE BLOWER REWARD FUND) on October 26, 2015. This emergency regulation expires on April 25, 2017. While a proposed regulation replacement has been drafted based upon input at the initial meeting of the Regulatory Advisory Panel that convened on October 12, 2016, subsequent action on the replacement for the emergency regulation has not occurred for a number of reasons including: • As a relatively new (OSIG was established effective July 1, 2012) and small agency (40 authorized positions with 29 employees currently) with a limited regulatory presence (this is our only regulation in process), OSIG does not have a position dedicated to regulation development. • Once OSIG determined the necessary course of action, the regulation development responsibilities were assigned to our Communications Coordinator position. The Communication Coordinator lacked any significant prior regulation development experience. • The Communications Coordinator worked with staff at the Virginia Register of Regulations and used information on their website (http://register.dls.virginia.gov/process.shtml), as well as coordinated with OSIG’s representative at the Office of the Attorney General, to move the regulation development process forward as she was able to do so while also performing her other job duties. The job duties for this position were extremely challenging for the past year due to unforeseen media attention involving the Office of the State Inspector General. • The Communications Coordinator subsequently terminated her employment with OSIG effective December 24, 2016. • OSIG contracted with an experienced Regulatory Coordinator effective February 13, 2017 to complete this regulation.

This emergency extension request was approved by the Governor's office on 4/14/2017.
