FanDuel Comments on Draft Sports Wagering Regulations
 
Dear Executive Director Hall:
I write to you today to share FanDuel’s initial comments regarding the draft sports betting regulations (“Draft Regulations”) to implement Chapter 1218 of 2020 as it relates to online sports betting in Virginia. We appreciate the time and careful consideration that went into the crafting of this legislation, particularly from Senator McPike and Delegate Sickles, as well as the comprehensive effort by Lottery staff in preparing the draft regulations.
FanDuel has been a leading operator of daily fantasy sports for over a decade, and a licensed operator in the Commonwealth since Virginia passed its fantasy sports law in 2016. Following the Supreme Court’s decision to strike down the Professional and Amateur Sports Protection Act (PASPA) in May of 2018, FanDuel has now become the leading sports wagering operator, and the largest online real-money gaming operator, in the United States. FanDuel currently operates eleven brick and mortar sportsbooks in eight states and online sports wagering in seven states. In 2018, FanDuel merged with Betfair US, which has been offering online casino wagering in New Jersey since 2013. We appreciate the opportunity to share our perspective on online sports betting regulation with you.
We offer the following comments regarding the drafting of regulations to implement Chapter 1218 of 2020. We have broken our comments out into four parts. The first part addresses the proposed “Virginia Sports Bettors’ Bill of Rights” and is our top priority. The remaining three parts address the three main divisions of the Draft Regulations.
