This is politics, not public health, and the Dept of Health's jurisdiction does not include it
 

There is no evidence of any real systemic problem here, despite the petition's bare allegations.  There is no evidence of males impersonating females trying to invade female spaces and males taking over female sports by pretending to be women.  The Department of Health should not be drawn into a political whirlwind created by activists who want chaos and headlines. In fact, I have heard of women who are larger than average and accomplished athletes being accused of being trans and having to prove that they are female, all because of this political hysteria. Schools can handle individual cases, as they arise (and if they arise) and deal with them in a wise and compassionate manner.  I add that there is not a scientific definition of what is female and what is male that is strictly binary.  There are numbers of variations in genetic makeup that can result in a child who will eventually be able to bear children and appears female having a penis of sorts, of a person appearing male who has ovaries and a vagina, for example. How will the Department of Health parse any of this?  Various school districts have had girls play on football teams or wrestling teams, and managed that.  The petition states baldly that it is being presented to support the "health" of Virginia's girl and women -- more likely it will case general harm to many people and at the same time not result in better team sports outcomes for the girls who claim to be victims.  In fact, institutionalizing the bare assertion that there is harm, by granting this petition, makes a finding that will cause all sorts of mischief for years to come.
