General Information
Action Summary 8VAC20-70 will be amended to align with procedures described in section 10.4.3 of the Department of Motor Vehicle’s Commercial Driver License Manual, which requires a bus to deactivate its 4-way hazard lights after it has crossed the track at a railway grade crossing. This will eliminate a discrepancy between procedures prescribed by the Department of Motor Vehicles and the Board’s regulations, which currently requires a bus to deactivate its 4-way hazard lights before the railroad tracks are crossed. The chapter will be further amended to match terminology and requirements found in 49 CFR § 380.605, which requires “entry level driver training instructors” must hold a CDL equal to or higher than the class for which they are providing instruction. The regulatory text will be amended to reflect that instructors must hold a Class B license with a P and S endorsement in order to align with this federal requirement. Next, the regulatory text will be amended to provide that buses which are purchased new must conform to the specifications in effect at the time of the bus’s manufacture as opposed to the time of its initial procurement. This change aligns with industry custom and will prove less burdensome for school divisions to track. Next, 8VAC20-70-130 will be amended to provide that a superintendent or their designee may receive the results of bus maintenance inspections which are performed by third party entities. This change is designed to align with language used in the rest of the chapter which provides that the superintendent or their designee may perform a given task. 8VAC20-70-400 will also be amended to add language which clarifies that drivers will be evaluated based on their performance and behind the wheel skills. This additional language is designed to further specify what drivers should be evaluated on, as opposed to generic language stating only that they should be evaluated. Lastly, 8VAC20-70-450 will be repealed and its language shifted to 8VAC20-70-460. This change is designed to streamline the Board’s regulatory catalogue and house similar requirements with similar requirements. Having one section which houses all requirements concerning specifications will better serve the public by enhancing ease of use and readability of the regulatory requirements.
