Action Summary |
This final exempt regulation is submitted to bring the regulation into compliance with state law. The General Assembly amended the Code of Virginia, at § 40.1-79.1. to permit counties, cities, or towns to authorize by ordinance any person residing anywhere in the Commonwealth, aged 16 years or older, who is a member of a volunteer fire company within such county, city, or town, with parental or guardian approval, to seek certification under National Fire Protection Association 1001, level one, firefighter standards, as administered by the Department of Fire Programs; and to work with or participate fully in all activities of the volunteer fire company, provided the minor has attained certification under National Fire Protection Association 1001, level one, firefighter standards, as administered by the Department of Fire Programs. |

This regulatory action is exempt from executive branch review pursuant to § 2.2-4006 A. 4. a. of the Virginia Administrative Process Act (APA) because it is necessary to conform to changes in Virginia statutory law where no agency discretion is involved.
