Exempt Action Pursuant to Change in State Law - Role of Localities

Action Summary |
This APA-exempt action revises the regulation to include provisions concerning the role of localities in the permit process for vegetation control on state rights-of-way. Chapters 512 and 543 of the 2006 Acts of Assembly revised the statutes concerning this regulation to allow localities greater authority where the application affected right of way not under the control of the Commonwealth Transportation Commissioner. The statutory amendments also provide for an appeals process to the Commonwealth Transportation Commissioner in cases where a locality rejected an application, and a fee of $400 to be filed with each appeal. |
