Action Summary |
New statutory provisions in ยง 36-105 of the Code of Virginia prevent an owner from transferring property to avoid bringing that property into compliance with the Uniform Statewide Building Code (USBC) when a notice of violation has been issued by the code official. When the owner transfers property that has an outstanding enforcement action pending and that owner still retains an ownership interest greater than 50%, the code official can continue to pursue enforcement action as opposed to having to start over again with the issuance of a new notice of violation.
The Board of Housing and Community Development adopted regulatory language that simply copies the exact language in the statute into the USBC in two sections. The first section is the USBC Construction Code Section 104.3 and the second section is the USBC Maintenance Code Section 104.1.2.
