Description of Proposed Guidance Document Changes
DPOR has previously posted to Virginia Regulatory Town Hall many agency policies. This document is included in the agency’s listing of guidance documents. This document pertains to DPOR and its operations generally and is not regulatory in nature. This action will make amendments to the following guidance document on Virginia Regulatory Town Hall: Policy #800-01: Criminal History and Online Public Records Information. The policy establishes guidelines for requesting and handling criminal history and public records information in compliance with federal and state laws and applicable information system service and security agreements. The following changes are made to the policy: a. Formatting of the document is changed. b. The policy is revised to provide that applicable agency staff, prior to accessing or receiving “Criminal History Information” as defined in the policy, must complete prescribed training identified by entities exercising oversight and control of Criminal History Information (e.g. Virginia State Police.) c. Provisions regarding the use and destruction of Criminal History Information are revised to provide that upon completion of an investigation, records must be destroyed in accordance with prescribed methods.
