Many OSE's have been routinely preparing designs for onsite sewage systems that do not comply with existing health rules and conditions. VDH 930 waivers often allow an owner to recieve a design wherein partially or untreated sewage is disposed of in unconfined aquifers.
Would designing an onsite sewage disposal system that doesn't meet the prescriptive VDH regulations constitute practicing engineering beyond the statutory scope authorized by law?
