Opposition to Executive Directive 14 (2025) and Proposed Regulation 12 VAC 5-660: Protect Privacy, H
 

I am a resident of Haymarket, Prince William County and I am writing to express strong and unequivocal opposition to Executive Directive 14 (2025) and its proposed regulation, 12 VAC 5-660. This regulation represents a dangerous and discriminatory policy that threatens the health, dignity, and privacy of all Virginians. The proposal establishes a system that is invasive, unworkable, and profoundly harmful. It would disproportionately target cisgender women who do not conform to traditional gender norms, subjecting them to humiliating scrutiny and undermining their right to privacy. 

Why You Must Reject This Regulation:

  • Undermines Trust in the Board of Health The Board of Health exists to safeguard public health, not to enforce political agendas. By advancing this regulation, the Board risks politicizing its mission and eroding public trust. Virginians depend on the Board to uphold evidence-based health policy, not discriminatory mandates.
  • Violates Privacy Through Invasive Policing Bathroom policing is a direct violation of personal privacy. No Virginian should be subjected to “gender inspections” in order to access basic facilities. Such practices are degrading, unsafe, and incompatible with the values of liberty and dignity.
  • Promotes Illegal Discrimination Federal and state laws prohibit discrimination based on gender identity. This regulation would place Virginia in direct conflict with established civil rights protections, exposing the state to legal challenges and reputational harm.
  • Harms Transgender Women’s Physical and Mental Health Denying transgender women and girls access to appropriate facilities and sports participation exacerbates health disparities. It increases risks of anxiety, depression, and physical harm, while isolating and stigmatizing an already vulnerable community. The Board of Health should be working to reduce health inequities, not deepen them.

The Health and Safety of the Commonwealth Depends on You

This regulation is not about safety—it is about division. It seeks to pit communities against one another, fostering fear and suspicion instead of solidarity. Policies that single out transgender people for exclusion are designed to fracture our communities and distract from the real public health challenges facing Virginia.

You must resist these efforts to divide us. The health of our Commonwealth depends on unity, compassion, and respect for diversity led by this board. Transgender women and girls are part of our communities, our families, and our future. Their existence, resistance, and resilience are undeniable.

Stop This Harmful Regulatory Action. 

I urge the Board of Health to stop this harmful regulatory action. Reject Executive Directive 14 (2025) and proposed regulation 12 VAC 5-660. Protect the privacy, dignity, and health of all Virginians.

This regulation is not only unnecessary—it is dangerous. It undermines trust, violates privacy, promotes discrimination, and harms health. The Board of Health must stand against policies that divide us and instead affirm the resilience and humanity of the trans community.

I ask you to fulfill your duty to protect public health by rejecting this regulation.
