12VAC5-410-81 Inpatient Hospital Fees

A. The fees for the initial, renewal, and change of licensure of hospitals shall be paid into the state treasury and credited to the Hospital and Nursing Home Licensure and Inspection Program Fund established by § 32.1-130 of the Code of Virginia.

B. The fee for an inpatient hospital change shall be $250. The commissioner may, in the commissioner’s discretion, waive or reduce an inpatient hospital change fee if an inpatient hospital provides substantial documentation justifying a waiver or reduction. A change to the following items shall constitute a change for which an inpatient hospital shall pay a change fee:

1. Address;

2. Operator;

3. Name of the inpatient hospital;

4. Any proposed change in management contract or lease agreement to operate the hospital;

5. Any change of hospital services requiring a Certificate of Public Need;

6. Ownership; or

7. Bed capacity.

C. An applicant for an initial or renewal license for an inpatient hospital shall pay the sum of the following fees:

1. A fee based on the number of inpatient beds in the hospital in the following amounts:

a. With less than 50 inpatient beds: $3,000;

b. With 50-99 inpatient beds: $6,000;

c. With 100-199 inpatient beds: $9,000;

d. With 200-299 inpatient beds: $12,000;

2. A per-bed fee in the following amount:

a. On or after January 1, 2026: $7.50.

3. A fee based on the number of operating rooms in the following amounts:

a. With 1-9 operating rooms: $3,000;

b. With 10-19 operating rooms: $6,000;

c. With 20 or more operating rooms: $9,000; and

4. A per-operating-room fee in the following amounts:

a. On or after January 1, 2026: $100.

12VAC5-410-82 Outpatient Surgical Hospital Fees

A. An applicant for an initial or renewal license for an outpatient surgical hospital shall pay the sum of the following fees:

1. A base fee in the following amount:

a. On or after January 1, 2026: $750.

2. A fee based on their number of operating rooms in the following amounts:

a. With 1-3 operating rooms: $750;

b. With 4-6 operating rooms: $1,500;

c. With 7 or more operating rooms: $2,250; and

3. A per-operating-room fee in the following amounts:

a. On or after January 1, 2026: $25.

B. The fee for an outpatient surgical hospital change shall be $250. The commissioner may, in the commissioner’s discretion, waive or reduce an outpatient surgical hospital change fee if a hospital provides substantial documentation justifying a waiver or reduction. A change to the following items shall constitute a change for which an outpatient surgical hospital shall pay a change fee:

1. Address;

2. Operator;

3. Name of the hospital;

4. Any proposed change in management contract or lease agreement to operate the hospital;

5. Any change of hospital services requiring a Certificate of Public Need;

6. Ownership; or

7. Number of operating rooms.
