Agency's Plan | Since section 35 has been amended in proposed regulations adopted pursuant to a periodic review to specify first and last names on the nametag, the Board will consider the 5 petitions during the 60-day comment period. In addition, legislation currently before the General Assembly that restricts the disclosure of licensee addresses on the internet may alleviate some of the petitioners' concerns. |

Agency Decision Summary | The request to amend the regulation has been denied because the Board has not yet received permission to publish the proposed regulation in which section 35 was amended and therefore cannot amend its proposal at this time. Once the proposed regulation is available for public comment, the petititioners' request will be noted and a specific response to their concerns given in the adoption of final regulations. Further, in compliance with legislative action by the 2003 General Assembly, the Board no longer posts street addresses or rural route numbers on the Internet, which should mitigate much of the petitioner's concern about privacy. |
