The State Air Pollution Control Board (Board) is authorized to name members to a State Advisory Board on Air Pollution (SAB) under the provisions of Section 10.1-1313 of the Code of Virginia and pursuant to its charter the SAB collects technical information from available sources and advises the Board and the Department of Environmental Quality (DEQ) on air quality issues in Virginia.
Over the years, the process for developing programs and adopting regulations has become more formalized through the procedures established in the Administrative Process Act including the use of regulatory advisory panels to assist in the development of proposed regulations. Also, the agency's use of specialized committees to assist and advise on an as-needed basis has become routine.
Since a formal group is not necessary to provide opportunities to assist the Board and DEQ and opportunities will continue to be made available, outside of the SAB, just as they are now; the Board will consider at its next regular meeting retaining the SAB charter for future use as the Board may deem necessary and placing the SAB in an inactive status.
