PURPOSE OF NOTICE: The Department of Environmental Quality (DEQ) is announcing an opportunity for persons interested in the Regulations for the Control of Motor Vehicle Emissions in Northern Virginia to serve on a regulatory advisory panel to assist in the development of regulatory amendments to establish an on-road clean screen program.
DEADLINE TO SUBMIT REQUESTS TO SERVE: June 6, 2012
BACKGROUND: Chapters 216 and 824 of the 2012 Acts of Assembly require the State Air Pollution Control Board to, among other things, incorporate into the Regulation for the Control of Motor Vehicle Emissions in Northern Virginia an on-road clean screen program. The on-road clean screen program will allow a motor vehicle owner to voluntarily certify compliance with emissions standards by means of on-road remote sensing. The percentage of motor vehicles eligible for emissions inspection through the on-road clean screen program during an applicable 12-month period is limited by statute as follows: July 1, 2012, through June 30, 2013 - no more than 10 percent; July 1, 2013 through June 30, 2014 - no more than 20 percent; and on and after July 1, 2014 - no more than 30 percent.
Necessary amendments to the regulations will include, but are not limited to changes in (i) the wording of some definitions, (ii) some elements of the remote sensing testing applicability and program procedure and protocol as they pertain to gross polluters and clean car screening, (iii) the remote sensing and clean screening test standards, (iv) some permitting and licensing procedures, and (v) some enforcement and compliance procedures.
REGULATORY ADVISORY PANEL: The Department is using a panel to assist in the development of regulatory amendments for adoption by the Board. Persons interested in assisting in the development of the amendments should notify the department contact by close of business on June 6, 2012, and provide their name, address, phone number, email address and their organization (if any). The primary function of the panel is to develop recommended regulation amendments for board consideration through the collaborative approach of regulatory negotiation and consensus. Multi-applications from a single company, organization, group or other entity count as one for purposes of making the decision specified in the preceding sentence. Notification of the composition of the panel will be sent to all applicants.
