Proposed subparagraph 2. “At the request of the licensee or director of the center or the Department of Social Services, a report of examination by a physician shall be obtained when there are indications that the center can no longer provide appropriate or safe care because of changes in the participant's physical or mental health.”
The requirement of a physical examination by a physician should not be required for discharge of a participant. It should be up to each center to determine if they are safely able to care for the participant, and as long as this is properly documented this should be sufficient.
Recommendation: Remove from regulation
