Congress enacted legislation creating the Federal Motor Carrier Safety Administration within the U.S. Department of Transportation. The FMCSA began operations on January 1, 2000. That legislation also vested in FMCSA the responsibility for licensing, permitting, and insurance registration of interstate motor carriers. Thus, to reflect the transfer of these functions to the FMCSA, we recommend that the reference to “Surface Transportation Board of the United States Department of Transportation, Federal Highway Administration” in Section 23VAC10-500-40(A)(1) be stricken and replaced with “Federal Motor Carrier Safety Administration.”
