On 4/12/2016 the board requested that this
emergency stage be extended until 12/28/2016.
Reason for Extension:
This regulation was promulgated pursuant to Chapter 327 of the 2014 as an emergency action; it was effective on 12/29/14 and expires on 6/28/16. After the effective date and in response to the NOIRA, the Board received comment requesting less burdensome requirements. A revised emergency regulation was submitted, simultaneous with the publication of proposed regulations to replace the emergency. However, the original expiration date was not changed. Proposed regulations were submitted 7/10/15 and approved 11/16/15. After the 60-day comment period, final regulations were adopted and submitted 2/25/16. They have been in the Secretary's office sent 3/10/16. The last day the final regulation can be submitted for publication in order to have a regulation in effect by 6/28/16 is 4/27/16. Since the regulation has not yet been approved by the Secretary or the Governor, it is highly doubtful that the Register deadline can be met, and an extension is requested until 12/28/16.
This emergency extension request was approved by the Governor's office on 6/3/2016.
