Description This regulation establishes the policies and procedures the Commonwealth Transportation Board will use in decisions regarding the designation and revocation of Scenic Highways and Byways. The Office of the Attorney General has found that this regulation is exempt from the APA under § 9-6.14:4.1 B3 (effective 10/1/01, § 2.2-4002 B3).

Federal Authority None.
Exempt from APA Yes, changes to this chapter of the VA Administrative Code are exempt from Article 2 of the Administrative Process Act.

Goals of Regulation VDOT seeks public comment regarding the following questions:

1. Does the regulation meet the following goals?

- To ensure that VDOT complies with state statutes concerning designation of Scenic Highways and Virginia Byways (Section 33.1-62 et seq.); and
- To protect the public's health, safety, and welfare with the least possible intrusiveness to the citizens and businesses of the Commonwealth.
