Prescription release to an agent
 
As regards the release of a prescription for spectales or contact lenses, neither is covered under HIPPA and any attempt to sidestep the Eyeglass II regulations should be viewed as an attempt to restrict Virginia consumers access to a competitive marketplace.  A formulary for spectacle lenses and contact lenses is not an indicator of any medical condition, but rather a mathmatical formula designed to fabricate corrective lenses.  Release of this formulary is in no way a violation of patient privacy.  However, failure or refusal to release the formulary would seem to violate the portability of a consumers property as defined by EyeglassII.
