Virginia lawmakers have already reviewed this topic and passed SB 1108 to limit sales of Kratom to adults (21+) and require clear labeling of products. It was passed on March 26, 2023.

Summary of the bill
Virginia Consumer Protection Act; prohibited practices; kratom products. Provides that it is a prohibited practice under the Virginia Consumer Protection Act to sell or offer for sale (i) any kratom product, defined in the bill, to a person younger than 21 years of age or (ii) any kratom product that does not provide a label listing all ingredients and with the following guidance: "This product may be harmful to your health, has not been evaluated by the FDA, and is not intended to diagnose, treat, cure, or prevent any disease."
