Description This regulation provides a recreational boating accident casualty reporting system, at the state level, in compliance with federal law and the Code of Virginia. A marine casualty reporting system, approved by the Secretary of the Department of Transportation and meeting the requirements of 46 U.S.C. 6102, is a required component of Virginia's State Recreational Boating Safety Program Agreement for the receipt of financial assistance in support of boating safety education, assistance, and enforcement activities. This regulation is essential to protecting citizen safety in recreational boating. It implements an immediate notification process in the event of an occurrence involving loss of life or disappearance. Specific requirements are provided that facilitate investigations of such occurrences. It establishes applicable timeframes for submitting casualty or accident reports and stipulates the information required for subsequent investigation. Preventative measures to mimimize accidents can be developed and implemented in accordance with insights gained from the accident reporting system.

Goals of Regulation To enable law enforcement authorities to effectively investigate the cirumstances of accidents and fatalities which occur in recreational boating. To provide for uniform boating accident and casualty reporting requirements which comply with federal laws and regulations.
