Description The regulation sets forth standards that are intended to implement the provisions of §§ 63.2-1701, 63.2-1817, 63.2-1734,16.1-278.2, 16.1-278.4, and 16.1-278.8 of the Code of Virginia relating to licensure requirements for child welfare agencies including licensed independent foster homes. The regulation allows licensed independent foster homes to accept children directly from the child’s parent(s) or legal guardian and without the involvement of any child-placing agency. The children accepted in these homes do not receive oversight or services from the local department of social services or a licensed child placing agency.

Goals of Regulation The regulation sets forth standards that are intended to protect the health, safety, and welfare of children placed in licensed independent foster homes by providing:
• requirements for services and supervision of the children;
• accommodations and safety of the home environment;
• recordkeeping protocols; and
• discharge planning that includes supporting reasonable efforts for the return of the child to the parent/guardian, whenever appropriate.
The standards allow these licensed homes to offer a time-limited, least restrictive, community-based home service option to families and their children.
