| Action Summary |
The Sewage Handling and Disposal Regulations serve to assure all sewage within the Commonwealth is handled and disposed of in a safe and sanitary manner to protect the safety, health, and welfare of the public. These regulations establish standards for (i) the determination of whether a permit for handling or disposing of sewage should be issued or denied, and (ii) the requirements necessary to secure a permit for handling and disposing of sewage.
This action amends the Regulations as follows:
i. Removes the requirement that only a health director may conduct informal fact-finding conferences (IFFC) and allows a designee such as a presiding officer to conduct these conferences pursuant to 2.2-4019 of the Code of Virginia;
ii. Amends cross references to Title 9 of the Code of Virginia as it was recodified to Titled 2.2;
iii. Removes restriction of subpoena power as it is allowed under 2.2-4022 of the Code of Virginia;
iv. Aligns the timetable to render a case decision with 2.2-4021(B) of the Code of Virginia; and
v. Removes the requirement for a hearings officer to submit their findings of fact to the Commissioner of Health for final decision.
