CHAPTER 250
PROCEDURAL RULE NO. 4 - PROXY VOTING BY BOARD MEMBERS (REPEALED)
9VAC25-250-10. Proxy conditions. (Repealed.)
Any member unable to be present at the time a vote is taken
by the board may vote by proxy, subject to the following conditions:
1. Each proxy must be in writing, dated and signed by the
member giving the proxy, and submitted to the chairman or his designate prior
to the time the vote is taken;
2. Each proxy must specify the question to be voted upon,
and the member's position thereon. Under no circumstances will a general proxy
be recognized;
3. In the event that the question to be voted upon is
materially modified prior to the vote, all proxies not reflecting such
modification shall be void. Restating an affirmative question in the negative,
or vice-versa, shall not be deemed a material modification for the purpose of
this paragraph;
4. No proxy shall be counted in determining the presence of
a quorum.
9VAC25-250-20. Presumption of validity. (Repealed.)
Any proxy meeting the above requirements shall be presumed
valid, and shall not be set aside by the members present; provided, however, that
the members present may determine by a majority vote when a question to be
voted on has been materially modified for the purpose of this chapter.
