6VAC40-15-10 Definitions

The following words or terms when used in this chapter shall have the following meanings unless the context clearly indicates otherwise:

"Department" means the Department of Forensic Science.

"Employee" means any individual retained for services rendered to the Department of Forensic Science or any of its tenants.

"Parking facilities" means any properties owned by the Department of Forensic Science and, with the consent of the property owner, any properties that may be leased, loaned, or otherwise provided to the Department in support of any event or other purpose where motor vehicle parking is to be provided.

"Motor vehicle" means any automobile, bus, truck, van, motorcycle, or motorized scooter requiring a license or registration for legal street operation.

"Parking manager" means the employee(s) of the agency designated by the Director of the Department and operating under the authority of the Director of the Department to enforce these regulations.

"Visitor" means any person who has business during established hours with the Department or its tenants and who is not presently and directly employed by the Department or its tenants.

6VAC40-15-20 General Prohibitions

A. All employees must park in the areas designated by the Department or its tenants unless special permission is granted by the Parking Manager.

B. Parking facilities shall be open to visitors to the Department or its tenants. Parking facilities shall be posted at all points of ingress and egress with a clearly legible sign containing the following wording:

VISITORS PARKING IN DESIGNATED AREAS

AUTHORIZED PARKING ONLY

TOWING ENFORCED BY

[NAME OF TOWING COMPANY]

CALL [TOWING COMPANY PHONE NUMBER]

FOR LOCATION AND INFORMATION

CONCERNING RETURN OF VEHICLE

C. All visitors shall park in the areas designated by the Department or its tenants. Only the Parking Manager may authorize a visitor to park in an area not designated for visitors.

D. Parking facilities are intended solely for the use of visitors with business on the premises during established hours and employees. No visitor or employee shall be permitted to park overnight in Department parking facilities without the approval of the Parking Manager. No other overnight parking is permitted. Vehicles parked overnight without authorization may be subject to towing at the owner's risk and expense without notice.

E. A motor vehicle parked in a fire lane or a roadway is subject to towing at the owner's risk and expense without notice.

F. A motor vehicle improperly parked in a handicapped area is subject to towing at the owner's risk and expense without notice.

G. A motor vehicle improperly parked in a reserved space is subject to towing at the owner's risk and expense without notice.

H. Any motor vehicle that blocks, impedes, or restricts another vehicle's ability to ingress or egress is subject to towing at the owner's risk and expense without notice.

6VAC40-15-30 Enforcement

A. The Parking Manager has the authority to enforce these regulations.

B. Operators of motor vehicles in violation of these regulations may be subject to towing of the motor vehicle at the owner's risk and expense.

C. Liability disclaimer. The Department, the Commonwealth of Virginia, and agents of the Department do not assume responsibility for any vehicle or its contents when parking in the Department's parking facilities. The Department, the Commonwealth of Virginia, and agents of the Department do not assume responsibility for damage to vehicles that are towed due to unauthorized parking or other parking violations.
