Description This regulation establishes criteria for determining in which cases identifying information on individuals involved in Child Protective Services (CPS) investigations should be entered into the child abuse and neglect central registry by local departments of social services and the length of time the information should be retained in the registry by the Department of Social Services. As set out in ยง 63.2-1515 of the Code of Virginia, the State Board of Social Services shall prescribe by regulation what information shall be contained in the child abuse and neglect central registry.

Goals of Regulation The goal of this regulation is to establish reasonable time periods to retain information on child protective services complaints to contribute to the protection of children. The central registry tracks individuals who have abused or neglected a child for two purposes:
1. To maintain a history available to local departments when subsequent reports arise involving the same individuals so local departments can make more prudent decisions in assessing child safety and risk; and
2. To provide a screening mechanism to identify individuals who have abused or neglected a child applying to child-related work, applying to be a foster or adoptive parent, or involved in custody matters.
