Description Section 9-6.14:7.1 of the Administrative Process Act (APA) requires each agency to develop, adopt and use public participation guidelines for soliciting the input of interested persons in the formulation and development of its regulations. Such guidelines shall not only be used prior to the formulation and drafting of proposed regulations, but shall also be used during the entire formation, promulgation and final adoption process. Furthermore, §10.1-104. of the Code of Virginia authorized the Department of Conservation and Recreation "To prescribe rules and regulations necessary or incidental to the performance of duties or powers conferred by law;..."to carry out the purposes and provisions of Title 10.1, Subtitle I.
