Re: PUBLIC NOTICE: Request for Comment on DRAFT ISP Guidance to Comply with Requirements of the U.S. Department of Justice’s Settlement Agreement with Virginia and the DBHDS Office of Licensing and the Department of Medical Assistance DD Waiver Regulation Requirements
Background
The 2018 Person-Centered ISP Guidance document is intended to address concerns that plans are not measurable as identified by the Independent Reviewer for the Settlement Agreement, the DBHDS Office of Licensing, and the Department of Medical Assistance Services (Medicaid). In the 11th Report to the Court, the Independent Reviewer stated the following:
For many of the individuals studied, the Case Managers did not fulfill several requirements of the Agreement. These requirements included:
• The outcomes in ISPs were not specific and measurable (p.40).
The discrepancy analysis suggested that the most frequent shortcomings in the Individual Support Plans remains:
• ISP has specific and measurable outcomes (p.43).
In addition, the DBDHS Licensing Regulations require “relevant and attainable goals, measurable objectives, and specific strategies for addressing each need” (12VAC35-105-665 A (1). Finally, the Department of Medical Assistance (DMAS) quality review process has produced repeated findings under 12VAC30-120-515 E (1-2) and 12VAC30-120-1064 A (3) where person-centered plans either do not contain required elements or do not provide enough information to determine progress.
Therefore, notice is hereby given of the following draft guidance relating to licensed providers is posted to Town Hall today, May 1, 2018.

This document provides guidance on the writing of person-centered ISP content to ensure measurability in accordance with the Settlement Agreement, DBHDS Office of Licensing, and Medicaid requirements (DMAS). |
The guidance is designed to establish standards related to measurability in the development of person-centered plans. |
It is not anticipated that the change shall have an impact on staffing or payment matters for the affected stakeholders as this guidance document clarifies what is currently required. |
