The State Water Control Board has received documentation asserting that attainment of the designated use for Gillies Creek in the City of Richmond is not feasible. The documentation has been received from the City of Richmond.
The Board, pursuant to § 62.1-44.19:7 E of the Code of Virginia, is seeking comment on the documentation submitted and if it constitutes reasonable grounds that attainment of the recreation use for Gillies Creek is not feasible. The comment period begins immediately and will end November 1, 2010. Following the comment period, the Board may allow the City of Richmond to conduct a use attainability analysis according to criteria established pursuant to the Clean Water Act and a schedule established by the Board.
