Notice of intended action: The State Water Control Board intends to consider drafting a proposal for the amendment of a regulation on water quality. A regulation is a general rule governing people's rights or conduct that is upheld by a state agency.
Regulation name: Water Quality Management Planning Regulation (9VAC25-720) and General Virginia Pollutant Discharge Elimination System (VPDES) Watershed Permit Regulation for Total Nitrogen and Total Phosphorus Discharges and Nutrient Trading in the Chesapeake Bay Watershed in Virginia (9VAC25-820).
Purpose of notice: The board is seeking comments through the Department of Environmental Quality on the intended regulatory action, including but not limited to 1) ideas to assist the board in the development of a proposal 2) the costs and benefits of the alternatives stated in the agency background document or other alternatives and 3) effects of the regulation on farm or forest land preservation. In addition, pursuant to Executive Order 14 (as amended, July 16, 2018) and § 2.2-4007.1 of the Code of Virginia, the agency is conducting a periodic review and small business impact review of the Water Quality Management Planning Regulation to determine whether this regulation should be terminated, amended, or retained in its current form.
