Disclosure Packet Notice
 

Our company has managed certain associations which have been described as "diminimus" because the governing documents do not have restrictions on the lots, do not give the Board architectural control, and do not allow the Board to create rules and regulstions.  The Declarant created the associations to be able to maintain common areas but simply did not want restrictions on the lots.  I am concerned that someone buying into this type of community could assume that all of these restrictions apply.  Is it possible to add a statement (in bold) to the effect of:  "This notice refers to community associations in general and may not apply in the particular association you are considering purchasing in.  We encourage you to read the documents within this package to familiarize yourself with the unique characteristics of this community and to confirm whether or not these statements apply in your individual case."

Forms for Resale Docs
 

My comments: 1. There are 2 "Item #19 on the POA form .   2. The documents are not forms for the prepared to complete as required in Code Sections 54.1-2350.3, 55-79.97 item #19 and 55-509.A.16.   3. Include the applicable Code Sections for cancelling the contract after receipt of the resale document. 4. The condo document speaks to "condominium instruments" a defined term in the Act to included recorded declaration, plats and plans, any exhibits, schedule, or certifications. Section 55-79.97. C of the Code does not include any of these documents in a Resale Certificate. 5. How will CICs be notified of the new requirement to include the Board's adopted form ?
