Rather than requiring notice of "sensitive" materials via class syllabus, I recommend amending regulations to require school boards to establish local guidelines governing opt-out procedures.  This would compel the actions desired (establishing procedures) without state intervention and permit local community debate over the definition of terms like "sensitive."  As many commenters are saying, those definitions are critical to the issue.
