22VAC40-131-80 License Capacity and Maximum Caseload Numbers

Page 47: Need to distinguish between “b” trainees and “c” trainees. One appears to be for public agencies and the second for LCPA. The regulations should more clearly distinguish the two references to trainees.
Caseload capacity for strictly LCPA is unclear. “C. For licensees that serve “both” foster care and treatment foster care populations, the licensee shall . . .” For agencies providing solely treatment foster care, is the maximum caseworker caseload 10 children or 15. Based on the wording, it would appear that the maximum caseload is ten children assuming all children served by the TFC Agency are in treatment foster care.
Page 48: D. The licensee shall include the following children in the capacity count:

3. A child not in the licensee's custody whose placement is supervised by the licensee. Needs clarification regarding infants and children in the custody of a parent who happens to be in foster care through an LCPA.
