Since more than 180 days have passed since the end of the NOIRA stage, a Time Frame Waiver must be granted by the Governor's office.

Agency Reason: On behalf of the Board of Education, the Department of Education submits the following request to waive the 180 day requirement to submit proposed regulations following the close of the NOIRA public comment period. A NOIRA was published August 12, 2013, to amend the Regulations Establishing Standards for Accrediting Public Schools in Virginia. A comprehensive review of the regulations was planned. The public comment period for the NOIRA ended September 11, 2013. The proposed regulations should have been submitted to DPB by March 10, 2014. Proposed revisions to the regulations were first reviewed by the Board of Education at its July 25, 2013 business meeting. At this time the proposed revisions were public and were shared with the Office of the Attorney General. The Board approved the proposed amendments to regulations at its meeting October 24, 2013. The final version of the proposed amendments had been shared with the Office of the Attorney General in advance of the meeting. Upon the Board’s approval, the proposed amendments were submitted to the Office of the Attorney General in the Town Hall system November 13, 2013. The Department and Board’s actions were in compliance with the 180 days requirements; however, the certification by the Office of the Attorney General has taken longer than expected and exceeded the 180 day requirement to submit proposed regulations.

The request was removed from the Gov’s pending list and information about missed time frame deadline will now be included in the agency’s annual report about such events
