Since more than 180 days have passed since the end of the
NOIRA
stage, a Time Frame Waiver must be granted by the Governor's office.
This waiver was requested on 2/20/2012
Agency Reason: The NOIRA for this action was published in the Virginia Register on April 11, 2011. To meet EO14 (2010) timeframes, the proposed regulation needed to have been submitted by November 7, 2011. The proposed regulation was scheduled to go before the State Board of Social Services October 19, 2011. Prior to that meeting, the Office of Attorney General advised the agency that the proposed regulation did not go far enough to fully comply with statutory requirements. Complying with the OAG advice required significant work to the proposed regulation. A Time Frame Waiver Request was forwarded to the Governor’s Office November 2, 2011, prior to the electronic waiver submission being an option.
