Draft revisions to POA disclosure form
 

Thank you for the opportunity to comment on this  topic. The revision appears to provide all of the neccessary information for property owners to fully  understand what buying into a POA entails.

My only comment is that some kind of penalty  needs to be included for POA's who do not follow through with the requirements of this form. My POA does not keep a record of covenant violations reported, respond to or enforce covenant violations nor even look at property for sale to see if there is a violation on the property. So they would merely state on the form that there is no violation on the property. My POA submits a reserve plan that does not enclude all of the common elements of the association. My association does not follow the By-Laws and actually states they are just a guideline and do not have to be followed.  Providing these statements on a disclosure packet without follow through and accuracy does not serve the community.

 

Since these items are to be included in the disclosre packet it seems to me there should be some protection for owners that the disclosed items be complete and adhered to by the board of directors.

 

I do think this should help owners and new board members realize what the board is supposed to be doing.
