Description §29.1-531 of the Code of Virginia states, "Unless otherwise provided by a regulation of the Board, it is unlawful for any persons to take or attempt to take any fish...except by fishing with hook and line or rod and reel, held in hand." This regulation allows for certain species, in certain locations, to be collected by means other than "hook and line or rod and reel, held in hand". Specifically, this regulation clarifies which fish species can be collected by haul seines, gill nets, and dip nets, and where and when these gear can be used. The personal haul seine, gill net, and dip net sections permit the public to continue traditional forms of harvesting nongame fish for "table use" (human consumption). The gill net and haul seine to take fish for sale sections allow limited commercial fishing opportunities for nongame fish in Back Bay and its tributaries. As specified in §29.1-416 of the Code of Virginia, "Haul seine to catch species designated by the Board for sale... The Board may permit a licensee to use...gill nets...to take for sale fish of any designated species in the waters of Back Bay and its tributaries." The sections that permit limited commercial fishing in Back Bay and it's tributaries are essential to protect the welfare (economic well-being) of those individuals that have invested in specific gear and depend on selling harvested nongame fish. Code prohibits the sale of fish unless specifically permitted by law or regulation of the Board. These sections are that authority. The commercial sections and personal use sections of this regulation are for performance of the important governmental function of providing and sustaining fishery resources and the use thereof. Code prohibits the use of any fishing methods other than "hook and line or rod and reel, held in hand" unless permitted by the Board. This regulation is that authority.
